Brazilian Patent and Trademark Office introduces monthly limit for Fast-Track Examination Requests in H04 field

The Brazilian Patent and Trademark Office (BRPTO) has issued Ordinance No. 07, published on September 01, 2026, establishing a new monthly limit for requests for fast-track examination of patent applications classified under H04.
As of September 1, 2026, each applicant may file up to 3 fast-track requests per calendar month for patent applications classified in H04 – Electric Communication Technique. The limit applies regardless of whether the previous requests are ultimately admitted or rejected, and, in the case of PPH requests, regardless of the outcome of the previous examination Office's decision. The monthly cycle runs from the first to the last day of each calendar month, with no extension.
Requests exceeding the monthly limit will not be admitted, although the patent application will continue under regular examination. The applicant can request a refund of the fee paid for an inadmissible fast-track request.
